Lang Baker & Klain's construction attorneys help Arizona contractors profit from solar construction and installation opportunities

Arizona’s climate, recent advances in solar technology, and an array of tax and other financial incentives have combined to create attractive solar energy-related opportunities for Arizona contractors.

Lang Baker & Klain represents a number of leading Phoenix-area solar contractors, advising them in legal areas that include ROC licensing, contract drafting and enforcement, mechanics’ and materialmen’s liens, other protections of prompt payment rights, and resolution of contract disputes.

Licensing

As with all types of construction and installation, the Arizona Registrar of Contractors requires that solar contractors are properly licensed. In general, a contractor must qualify as a solar contractor to install, alter or repair a solar device, and must hold the license that is appropriate to the type of solar device being installed.

Following is a list of ROC license classifications and descriptions related to solar-related construction and installation:

Boilers, Including Solar

Related ROC requirements

  • Contractors holding Residential and Commercial General Contracting and Remodeling licenses may contract for solar installations, but all work pertaining to the installation must be subcontracted to a properly licensed solar plumbing, air conditioning, boiler, electrical or swimming pool contractor. Exceptions: A-General, B-4 General and KA-Dual Engineering Licenses may perform solar installations.

  • Roofing tiles that function as solar collectors must be installed by a C-42, L-42 or K-42 roofing contractor. However, connection of these tiles to the electrical system can be performed only by a licensed electrical contractor.

  • Roof-mounted solar or other devices that might compromise the roof components or void the existing roof warranty might require inspection and/or installation by a licensed roofing contractor.
